繼隆基綠能與晶科能源之后，又有兩大光伏龍頭在專利糾紛上達成和解。

11月29日00:00左右，正泰新能和晶澳科技同時發(fā)布《關(guān)于達成專利糾紛全球和解的聯(lián)合聲明》。

根據(jù)和解協(xié)議，雙方同意：終止在全球范圍內(nèi)正在進行的全部專利糾紛法律程序，并就雙方各自持有的TOPCon專利達成交叉許可；而且雙方承諾，在全球范圍內(nèi)不再就TOPCon專利向?qū)Ψ教崞鹑魏螌＠嚓P(guān)的訴訟或其他程序。

今年9月19日，隆基綠能與晶科能源共同發(fā)布《關(guān)于達成專利訴訟和解的聯(lián)合聲明》，宣布就雙方及雙方關(guān)聯(lián)公司在全球范圍內(nèi)正在進行的相關(guān)專利主張和法律事項達成和解協(xié)議。

正泰新能與晶澳科技在和解協(xié)議中稱，此次和解的達成，是雙方守正創(chuàng)新、互利共贏的務(wù)實體現(xiàn)，也為行業(yè)構(gòu)建健康、可持續(xù)的知識產(chǎn)權(quán)合作模式樹立典范；雙方將立足新起點，凝心聚力，持續(xù)強化前沿技術(shù)研發(fā)，推動高效光伏技術(shù)商業(yè)化落地與場景創(chuàng)新，并攜手開拓更深層次、更寬維度的戰(zhàn)略協(xié)同。

過去一年多，光伏陷入內(nèi)卷式競爭，其中一個重要體現(xiàn)是專利侵權(quán)糾紛案不斷涌現(xiàn)。此后，反內(nèi)卷成為了行業(yè)主旋律。

兩個多月來，四大光伏龍頭在專利糾紛上達成全球和解，這對光伏行業(yè)來說是轉(zhuǎn)向利好的信號，也意味著光伏反內(nèi)卷取得了重要進步。

隨著全球能源轉(zhuǎn)型加速，中國光伏產(chǎn)業(yè)正在邁入以技術(shù)創(chuàng)新引領(lǐng)的“質(zhì)量躍升”新階段。正泰新能科技股份有限公司（以下簡稱“正泰新能”）與晶澳太陽能科技股份有限公司（以下簡稱“晶澳科技”）作為行業(yè)的重要推動者，始終秉持創(chuàng)新驅(qū)動的發(fā)展理念，持續(xù)加大研發(fā)投入，完善全球知識產(chǎn)權(quán)布局，打造維護尊重和保護知識產(chǎn)權(quán)的市場環(huán)境，共同致力于推動產(chǎn)業(yè)技術(shù)進步與可持續(xù)發(fā)展。

(hereinafter referred to as “JA Solar”), as key industry promoters, have consistently prioritized technological innovation, increased investment in R&D, and strengthened their global intellectual property portfolios. Both parties are committed to fostering a market environment that upholds and safeguards intellectual property rights. Both companies remain committed to advancing PV technologies and supporting the sector’s long-term sustainable development.

2025年11月29日，正泰新能與晶澳科技聯(lián)合宣布：雙方及雙方關(guān)聯(lián)公司（以下簡稱“雙方”）針對在全球范圍內(nèi)正在進行的專利糾紛已達成和解。

Building on mutual agreement, on November 29, 2025, Astronergy and JA Solar jointly announced that the two companies and their affiliates (hereinafter referred to as “Two Sides”) have reached a settlement regarding the patent disputes currently ongoing worldwide.

根據(jù)和解協(xié)議，雙方同意：終止在全球范圍內(nèi)正在進行的全部專利糾紛法律程序，并就雙方各自持有的TOPCon專利達成交叉許可；而且雙方承諾，在全球范圍內(nèi)不再就TOPCon專利向?qū)Ψ教崞鹑魏螌＠嚓P(guān)的訴訟或其他程序。

Under the terms of the agreement, the Two Sides agree as follows:

? All ongoing legal proceedings relating to patent disputes worldwide shall be terminated;

? The Two Sides have reached an agreement on cross-licensing of TOPCon-related patents owned by each side;

? For the term of the agreement, the Two Sides undertake that, in the future, neither shall initiate any litigation or other proceedings against the other in any jurisdiction worldwide in relation to TOPCon-related patents.

The successful conclusion of this settlement reflects the Two Sides’ commitment to integrity, innovation, mutual benefit, and pragmatic cooperation. Moving forward from this new starting point, the Two Sides will continue to focus their efforts on strengthening R&D in cutting-edge technologies, promoting the commercialization and application of high-efficiency PV technologies, driving scenario-based technological innovation, and jointly exploring deeper and broader strategic collaboration.
