近日,“15歲女孩偷賣家中奢侈品”一事,引發關注。
據湖南都市頻道風芒新聞2月23日報道,湖南長沙15歲少女賤賣家中貴重物品換新手機,總價值13萬的手表、包包等奢侈品,僅賣了9300元。
A 15-year-old girl in Changsha, Hunan province, has sparked public debate after selling luxury items from her family home to a secondhand store at a steep discount. The girl is reported to have sold the goods with the aim of making enough money to buy a new smartphone.

對此,女孩家長丁女士表示震驚與憤怒,“對于對方是否是未成年人,(奢侈品回收平臺)沒有進行審核把關。”
The items, including watches and designer bags worth about 130,000 yuan, were reportedly sold for just 9,300 yuan. The girl's mother, surnamed Ding, said the stop failed to verify the seller's age.
涉事門店工作人員則稱回收價并非9300元,但拒絕透露具體金額。
據九派新聞消息,長沙芙蓉區市場監督管理局工作人員表示,相關科室已關注到此事,正在進一步了解具體情況。
涉事門店在社交平臺上顯示已暫停營業,一工作人員稱24日已沒有營業。
Shop staff disputed the reported price but declined to disclose the actual amount. Local regulators in Furong district said the case is under investigation, and the store had suspended operations as of Tuesday.
律師:15歲屬限制民事行為能力人
回收平臺負有審核義務
河南澤槿律師事務所主任付建認為15歲女孩屬于限制民事行為能力人,對其在二手平臺所售的高價奢侈品的真實價值超出認知水平,與其年齡、智力和精神健康狀況并不相適應,屬于效力待定的買賣合同,因監護人拒絕追認不產生法律效力。
Fu Jian, a lawyer at a Henan-based law firm, said a 15-year-old is considered to have limited civil capacity under Chinese law, meaning transactions involving high-value items may be invalid without guardian approval.
《民法典》第157條規定民事法律行為無效、被撤銷或者確定不發生效力后,行為人因該行為取得的財產,應當予以返還;不能返還或者沒有必要返還的,應當折價補償。有過錯的一方應當賠償對方由此所受到的損失;各方都有過錯的,應當各自承擔相應的責任。法律另有規定的,依照其規定。
回收平臺負有審核義務,如果其審核機制并不完善,依據流程不能核實賣方身份的,具有過錯;監護人未對孩子履行謹慎的監護義務,對損害結果發生也具有過錯。監護人可以追回孩子處分的財物,奢侈品已被轉售、毀損或滅失無法返還,則應按市場價值進行折價補償,交易中產生的損失可根據雙方過錯程度各自分擔部分損失。
Under China's Civil Code, property obtained through invalid transactions must be returned or compensated at market value if restitution is impossible. Fu added that stores are responsible for verifying sellers' identities, while guardians may also bear responsibility if supervision is inadequate.

“未成年人賤賣家中物品”時有發生
一地消保委出手:交易無效
中青報記者注意到,事實上,未成年人偷偷賤賣家中物品,并非個例。
據河南廣電民生頻道2025年10月15日報道,河南10歲男孩偷偷賣掉姥姥的黃金吊墜,13克黃金賣了4200元。

不久前,“11歲女孩偷賣家長黃金”的消息,也登上微博熱搜。浙江紹興張先生家里的黃金項鏈、耳環足足20多克,被孩子拆成6次偷賣到金店,換了16000多元。

無獨有偶,趙先生家祖傳的6個銀手鐲,被13歲的兒子偷賣,部分銀手鐲已被商家熔掉。收到相關投訴后,紹興柯橋區消保委迅速介入,判定這些交易通通無效,家長退還回收所得款項,商家在退還部分首飾原物的同時,余下已熔毀飾品換成同克重飾品退回。
Similar cases have been reported in recent years, with minors secretly selling family jewelry without parental consent. In one case in Shaoxing, Zhejiang province, disputed transactions were ruled invalid, requiring merchants to return the items or provide replacements.
“兩個案例中,兩名未成年人作為限制民事行為能力人,多次出售家庭大宗貴重物品,明顯超出其行為能力范疇,監護人拒絕追認,交易應屬無效。金店、首飾店作為專業經營者,在明知交易對象是未成年人的情況下,未核實監護人同意、評估交易適當性,存在明顯過錯。同時,家長未能妥善保管財物并履行監護職責,亦是事件發生的重要因素,因而雙方均需承擔相應責任。”

據統計,一年內當地已受理類似投訴36起,涉事者年齡最小11周歲,涉及金額最高超過18000元。
Local consumer officials said dozens of similar complaints were recorded last year, with some cases involving children as young as 11 and raising concerns over verification standards in secondhand trading and parental supervision.
