A petrol station in Hebei province has sparked controversy for allegedly mimicking a major state-owned oil brand in its name and visual identity, raising concerns over possible trademark infringement and unfair competition.

近日,一河北網(wǎng)友發(fā)帖稱,“大意了,這也太像中石化了”!該網(wǎng)友回憶,當(dāng)時(shí)還在納悶為何油價(jià)如此便宜,然而工作人員表示,他們不是中國石化,而是中園石化。
The issue trended on social media on Tuesday after a netizen said they had mistaken "Zhongyuan Petrochemical" for a well-known national chain due to its similar branding, only to later discover it was unrelated.

該網(wǎng)友發(fā)布的圖片顯示,“中園石化”為紅底白字,和同為紅底白字的中國石化只有一字之差,英文“SNOPEC”也只是少了一個(gè)字母“I”。
Images circulating online show the station using a red-and-white color scheme nearly identical to that of its better-known counterpart, with the English name "SNOPEC" differing from "SINOPEC" by just one missing letter.

該涉事加油站相關(guān)人員回應(yīng)稱,加油站已經(jīng)營十多年,一直使用該名字,且已通過了審批。
Staff said the station has operated under the name for over a decade and has obtained the necessary approvals.
對(duì)此,有不少網(wǎng)友質(zhì)疑,“中園石化”這類名稱,存在碰瓷嫌疑。

據(jù)極目新聞,記者查詢天眼查發(fā)現(xiàn),該加油站為石家莊市鹿泉區(qū)中園石化百尺桿加油站,曾用名為鹿泉市中園石化加油站。

鹿泉區(qū)市場監(jiān)督管理局工作人員回應(yīng),僅憑站名還不好判定,是否侵權(quán)還要根據(jù)裝修情況來綜合判定,他們將派人現(xiàn)場調(diào)查。
Local regulators said the name alone is insufficient to determine whether infringement has occurred, adding that an on-site assessment of the station's overall design and presentation is required.
這樣的情況并非個(gè)例。據(jù)此前報(bào)道,江蘇揚(yáng)州儀征市一加油站曾因侵犯中國石化注冊(cè)商標(biāo)專用權(quán),被行政處罰10000元。該站所用的標(biāo)識(shí)與中國石化官方logo近似,容易造成消費(fèi)者混淆和誤認(rèn),損害了消費(fèi)者的利益。

律師:可能構(gòu)成商標(biāo)侵權(quán)與不正當(dāng)競爭
北京德和衡律師事務(wù)所副總裁、高級(jí)權(quán)益合伙人陳燕紅告訴中青報(bào)·中青網(wǎng)記者,從法律層面分析,該行為有可能構(gòu)成商標(biāo)侵權(quán)與不正當(dāng)競爭。
依據(jù)《中華人民共和國商標(biāo)法》第五十七條第二項(xiàng)規(guī)定,未經(jīng)商標(biāo)注冊(cè)人許可,在同一種商品或服務(wù)上使用與其注冊(cè)商標(biāo)近似的商標(biāo),容易導(dǎo)致混淆的,屬于侵犯注冊(cè)商標(biāo)專用權(quán)。中國石化對(duì)“中國石化”“SINOPEC” 及相關(guān)組合標(biāo)識(shí)享有合法注冊(cè)商標(biāo)專用權(quán),核定使用于成品油零售服務(wù),該商標(biāo)經(jīng)長期使用已具備極高市場知名度與顯著性。
Legal experts said the case may involve violations of China's Trademark Law and Anti-Unfair Competition Law, noting that the use of similar marks in the same sector in a way that causes confusion can constitute infringement.
“中園石化” 在相同的成品油零售服務(wù)中,將 “中園石化”“SNOPEC” 及近似紅底白字裝潢用于招牌、燈箱等商業(yè)標(biāo)識(shí),屬于商標(biāo)性使用;其名稱與 “中國石化” 僅一字之差、字形讀音高度近似,英文標(biāo)識(shí) “SNOPEC” 與 “SINOPEC” 僅少一個(gè)字母 “I”,整體視覺與讀音均可能造成消費(fèi)者混淆,存在被認(rèn)定為商標(biāo)侵權(quán)的可能性。
其次,“中園石化” 的行為還可能構(gòu)成不正當(dāng)競爭。“中園石化” 通過刻意模仿 “中國石化” 的名稱、英文標(biāo)識(shí)、招牌配色與整體布局,若主觀上具有明顯攀附他人商譽(yù)、“搭便車” 的惡意,客觀上足以使普通消費(fèi)者產(chǎn)生誤認(rèn)并可能擾亂了公平競爭的市場秩序,還可能依法應(yīng)認(rèn)定為不正當(dāng)競爭行為。
They added that the established brand holds registered rights over its names and visual identity, and that imitation which misleads consumers could also amount to unfair competition if intended to benefit from its reputation.
