代表建議:落實雙休制、升級年休假
“當前,我國勞動人口存在‘沒假休’‘不能休’‘不敢休’的情況,這不僅影響群眾幸福感,也制約了消費潛力的釋放。”全國人大代表,浙江安吉余村黨支部書記、村委會主任汪玉成接受媒體采訪時表示。
“目前的年休假制度中,假期時限與工齡長短的銜接過于僵硬。”汪玉成指出,根據(jù)2008年頒布的《職工帶薪年休假條例》,職工累計工作已滿1年不滿10年的,年休假僅5天。
在我國人口結(jié)構(gòu)老齡化加劇的背景下,工齡10年以下的青年勞動力正成為社會發(fā)展的中堅力量,承受著較大的物質(zhì)和精神壓力,5天的法定年休假難以保障其充分休息。

He noted that the current system grants only five days of paid annual leave to employees with one to 10 years of cumulative work experience, which he said is insufficient for younger workers facing growing pressure.

他還表示,年休假制度對占旅游市場主體地位的青年群體也形成了消費抑制。
針對上述問題,汪玉成建議嚴格落實現(xiàn)有工時規(guī)定,守護勞動者“雙休權(quán)”。 對企事業(yè)單位工時執(zhí)行情況加強監(jiān)督管理,讓“雙休制”從紙面走向現(xiàn)實。
強制實施帶薪年休假,將落實帶薪年休假作為勞動保障監(jiān)察的重點內(nèi)容,加大執(zhí)法檢查力度,并將企業(yè)落實情況與獎懲、信用、等級評定掛鉤,激勵企業(yè)主動履行義務(wù)。
同時,修改年休假天數(shù)規(guī)定,按工齡遞增讓青年“多休假”。

2026年全國兩會期間,全國人大代表、遼寧大學校長余淼杰提交了關(guān)于進一步推進節(jié)假日改革,釋放消費潛力的建議。
建議將最低法定年假從5天提高到10天,并允許未休年假在兩年內(nèi)結(jié)轉(zhuǎn)使用,強化彈性休假能力,同時對年假使用率低的單位加強監(jiān)管。

《職工帶薪年休假條例》將修訂
今年年初,人社部在例行新聞發(fā)布會上表示將推動修訂《職工帶薪年休假條例》,促進用人單位落實該制度。

在我國,職工帶薪年休假的權(quán)利可以追溯到1994年頒布的勞動法。2008年1月1日,《職工帶薪年休假條例》正式施行。同年發(fā)布的《企業(yè)職工帶薪年休假實施辦法》進一步細化規(guī)則,至此形成相對完整的制度框架。
《職工帶薪年休假條例》規(guī)定:職工累計工作1到10年,年休假5天;10到20年,休10天;20年以上,休15天。因工作需要不能安排休假的,單位應(yīng)予以日工資收入300%的補償。
時隔18年,這項事關(guān)4.02億職工休息休假權(quán)的制度有望“上新”。
專家表示,查漏補缺、優(yōu)化供給、增強剛性或是此次條例修訂的核心議題,讓“想休不敢休”真正變成“應(yīng)休盡休”。不只是權(quán)利回歸,更是制度升級的關(guān)鍵。
China introduced paid annual leave in the national labor law in 1994, with the current regulation taking effect in 2008. Employees with one to 10 years of service receive five days of leave annually. After 18 years, the regulation affecting more than 400 million workers may be revised, with experts expecting stronger enforcement.
