1月15日,“深圳工會”發(fā)布一則案例,深圳一公司領(lǐng)導(dǎo)要求員工小明(化名)在公司年會表演脫口秀,小明以工作繁忙為由拒絕。領(lǐng)導(dǎo)認為小明“不給面子”。次日,公司給小明開具《解除勞動合同通知書》,理由為不服從公司安排、曠工,屬嚴重違紀。

A Shenzhen court has ruled that a company unlawfully dismissed an employee for refusing to perform at its annual gala, ordering the employer to pay compensation.
According to a case shared on Thursday by the city's official labor union, an employee identified as Xiaoming (pseudonym) was asked to perform a stand-up comedy routine at the company's annual meeting but declined, citing a heavy workload. Management accused him of being "disrespectful" and dismissed him the following day for alleged disobedience and absenteeism, labeling the conduct a serious violation of company rules.

小明不服公司解除決定,于是通過勞動仲裁維護自身權(quán)益。該案經(jīng)由仲裁裁決、一審判決及二審調(diào)解,法院最終認定案涉公司系違法解除勞動合同,需一次性向小明支付賠償金。
Xiaoming challenged the decision through labor arbitration. Following arbitration, a first-instance ruling and a second-instance mediation, the court found the dismissal unlawful and ordered the company to make a one-time compensation payment.
那么,年會究竟是否屬于工作范疇呢?
據(jù)深圳工會介紹,首先,要看年會是否為員工自愿參加,如果用人單位組織年會時,明確提出“全員參加”并將其與考勤、績效等掛鉤,使得員工不參加可能面臨不利后果,那么這類活動就具備強制性。
反之,如果用人單位明確活動遵循自愿原則,不進行考勤、不參加也無任何處罰,還可能為參與者提供便利或補貼,那么此類活動就更接近于企業(yè)提供的福利性質(zhì)。
The labor union said the key issue in such cases is whether participation is voluntary or not. If an employer requires all staff to attend and links attendance to performance reviews, attendance records or other workplace consequences, the event may be deemed compulsory and therefore part of employees' work duties.
By contrast, if participation is clearly optional, with no attendance checks, penalties or negative consequences for opting out, and with possible subsidies or other incentives for participating, the event is more likely to be considered an employee welfare activity.
深圳工會提醒:要特別注意的是,用人單位不能借年會的名義,對員工濫用管理權(quán)和處罰權(quán),對于非強制的公司活動,員工有權(quán)拒絕,用人單位不能以此為由解除勞動合同或克扣工資;對于強制要求參與的公司活動,在工作時間以外的,用人單位要依法給予補休或加班費,同時應(yīng)當保障好活動期間員工的休息權(quán)等合法權(quán)益。
The labor union also stressed that employers must not abuse managerial or disciplinary powers under the pretext of organizing annual events. Employees have the right to refuse non-mandatory activities, and companies may not dismiss staff or withhold their salary on that basis. For compulsory events held outside regular working hours, employers are required to provide overtime pay or compensatory leave.
